FLINT, Michigan -- For nine years, Freda Burroughs has been waiting for justice in her sister's death. She sat through court testimony from her young niece, a witness to Iris Massey's death. She saw the man charged with killing her sister get sent to life in prison -- but for a different slaying, one that happened five years after her sister died. Burroughs and the rest of her family are still waiting for closure, waiting for a trial that now may never happen. 'We've been waiting all this time for justice,' Burroughs said. 'For it not to happen is a slap in the face.' Prosecutors are still trying to determine if they will go ahead with a trial for Calvert Massey, who was charged in 2005 with the slaying of Iris Massey, his 29-year-old wife. Prosecutor David Leyton said there is concern that that the Masseys' daughter, who was expected to testify against her father, might not be able to do so. Oct 10, 2010. 'We're concerned for her mental health status and how testifying will impact the minor,' Leyton said. A psychologist told officials earlier this year that having the girl -- who is now 12 but was 3 the time of her mother's death -- testify would have a negative impact on her. Her family, however, said they don't believe testifying would be detrimental to her mental health. The girl testified in a preliminary examination in her mother's case, as well as in the 2005 trial in the slaying of Alicea C. Calvert Massey was convicted in that case. What makes the case even more unusual is that one defendant is charged with two separate homicides. Leyton said he has not seen that since he became prosecutor. Usually if someone charged in multiple murders, they most likely are related or the person is a serial killer. 'This is the first time since I've been here that I've had to decide to prosecute a murderer that is already locked up forever in an unrelated case,' he said. Jones-Blade, 28, the daughter of a pastor, was found hanging by the neck and handcuffed in the bedroom closet of her first-floor apartment in Mt. Morris Township. Massey lived in the same complex. Massey's daughter testified in Jones-Blade's trial that she witnessed her father strike her mother and later was with him when they drove to a Dumpster and placed a bundle in the bin. She was 3 at the time of the incident and testified when she was 7. Iris Massey's body was found in a trash bin at Clio and Pierson roads on Oct. She had been strangled. 'It's not like she's forgotten one incident,' Burroughs said of the girl. 'Her repeating it at 12, when she did it at 7, is not going to hurt. Her speaking on her mother's behalf, that would be better for her.' The trial was expected to start last month, but was adjourned so prosecutors can re-interview the girl. So far, that has not happened. 'We were leaning toward not having a trial, but the families voices were heard,' Leyton said. He said, however, there are other issues with having a trial. One includes the burden on taxpayers to try a man who already is in prison for the rest of his life without parole. Iris Massey's family said the fact that Calvert Massey already is in prison should not matter. 'I know things can change,' said Stanley Turner, Iris Massey's father and a retired Chicago homicide detective. 'He could be released. 'The family wants to go forward. ![]() If we believed in any way that for (the daughter) to testify would cause problems, then she would not be testifying.'
